Licences needed to start a hotel in India

Opening a hotel, resort, homestay or guest house in India needs approvals from several departments — the local municipality, state fire services, pollution control board, police, labour department and, if you serve food or alcohol, the food safety authority and state excise. The exact list depends on your state, city, building size and what services you offer. This free hotel licence checklist builds a personalised planning list from your answers, grouped by department, with who issues each approval and why it applies to you.

This is a planning checklist, not legal advice. Requirements, fees and thresholds change and differ by state and city. Confirm every item with the local authority, your CA or a licensing consultant before you apply.

The usual order of approvals

  1. Before construction or lease: confirm land use and building plan approval, and apply for Pollution Control Board consent to establish where needed.
  2. Before opening: occupancy or completion certificate, fire NOC, trade licence, Shops and Establishments registration, FSSAI, lift and DG set approvals, police registration and GST.
  3. Before serving alcohol or playing music: state excise licence and PPL / IPRS music licences.
  4. As you grow: EPF at 20 employees, ESI at 10 employees in notified areas, tourism registration and voluntary star classification.

Common mistakes

  • Opening before the fire NOC is in hand — it is often the slowest approval and many OTAs and insurers ask for it.
  • Forgetting renewals. Trade licence, FSSAI and liquor licences have validity periods; keep a calendar.
  • Not filing Form C within 24 hours for foreign guests. Add the step to your check-in process — our guest registration card includes a Form C section.
  • Playing music in the lobby or restaurant without PPL and IPRS licences.
  • Ignoring state homestay schemes, which often come with conditions on owner residence and room count.

Frequently asked questions

What licences are needed to open a small hotel in India?

Most small hotels need a trade licence, Shops and Establishments registration, building occupancy certificate, fire NOC where applicable, police registration, FSSAI if food is served and GST once turnover crosses the threshold. Exact rules vary by state and city.

Do homestays need a fire NOC?

It depends on the state and the size of the building. Some states relax fire and other rules for small registered homestays under their homestay scheme. Check with your state tourism department and local fire office.

Is this checklist legal advice?

No. It is a planning checklist based on common requirements in India. Requirements differ by state and city, so confirm each item with the issuing authority or a professional before applying.
